The states of Florida, Alabama, Idaho, Indiana, Louisiana, Michigan, South Carolina, Utah, Virginia and Wyoming sent a brief to the 9th Circuit U.S. Court of Appeals saying that the Constitution does not require marriage to include same-sex couples and that states, not federal courts, have the final say in whether to allow same-sex marriages. The court had previously ruled that only California Governor Arnold Schwarzenegger and California Attorney General could appeal a lower court’s ruling and that California’s anti-same-sex marriage, Proposition 8, was in opposition to the U.S. Constitution.
