First Same-Sex Divorce in Missouri Processed

Posted on 07 May 2014

Columbia, MO – A Boone County judge has granted what is being called the first same-sex divorce in Missouri, which currently has a constitutional amendment against recognizing same-sex marriages.

In the ruling, Boone County Circuit Judge Leslie Schneider granted the divorce for Samantha and Dena Latimer, who married in Massachusetts in 2009 while living in Columbia, Missouri. The judge ruled that under the doctrine of “comity,” a Missouri court can recognize the law of where the marriage was performed for “the limited purpose of granting equitable relief,” according to a report by the Columbia Tribune.

Lambda Legal representative Christopher Clark told the Tribune that while this is the first case in Missouri, it’s bound to happen.

“Same-sex couples are like everybody else in that they have relationships that sometimes don’t work out,” Clark said to the Tribune.
