First Gay Couple To File For Bankruptcy

Posted on 19 May 2013

Fort Meyers – A gay couple in Florida is attempting to file for joint bankruptcy in Florida, which as we know, does not honor same-sex marriages. Daniel Maltbie and Garry Houston were reportedly married in Vermont, but currently live in Florida. While their marriage is honored in Vermont, it is not honored here. But when the couple fell behind on their mortgage and tried to file for bankruptcy, the bankruptcy courts themselves were left scratching their heads. A Florida bankruptcy court wondered whether or not they were eligible for the joint bankruptcy benefits that other married couples receive. Florida hasn’t ever addressed the issue of gay married couples filing for joint bankruptcy, so it’s new to both parties. The bankruptcy agent who is in charge of their case has asked for two to three weeks before making a decision.
