INDIANAPOLIS (AP) – The operator of five Indianapolis-area Subway restaurants has agreed to pay $50,000 to settle a federal discrimination lawsuit filed over its firing of an HIV-positive employee.
The U.S. Equal Employment Opportunity Commission announced its settlement Tuesday with the Subway franchisee, KAY QSRS Inc.
The federal agency’s lawsuit alleged that the franchisee fired an employee at its Subway store in the Hamilton County town of Sheridan in January 2015 after he disclosed to a manager that he was HIV positive.
The EEOC says firing an employee based on that person’s HIV status violates the Americans with Disabilities Act.
The settlement with the franchise also bars it from engaging in any future discrimination against employees or job applicants with disabilities.
An attorney for the franchisee declined to comment Tuesday on the settlement.
